1. Acceptance of these terms
These Terms of Service ("Terms") form an agreement between you and SafeHaven. They govern your use of the SafeHaven website (safehaven.example and its subpages), the intake form, the self-check, the family cybersecurity subscription service, and any related communications we send you about your account.
By submitting our intake form, starting a subscription, or using any part of the service, you agree to these Terms and to our Privacy Notice. If you do not agree, please do not submit the intake or use the service.
If you are accepting these Terms on behalf of a household, you represent that you have authority to do so for every household member whose information you provide.
2. Description of services
SafeHaven is a managed family cybersecurity service. The Family Plan we sell today, at $250 per month, covers a single household across three operational pillars:
- Guardian — Device & Network. Endpoint protection across household devices, network hardening, vulnerability assessment, and continuous monitoring with human review.
- Analyst — Threat Monitoring. Dark web and breach catalog monitoring, compromised-credential monitoring, and account security assessment for the household's accounts.
- Strategist — Identity & Recovery. Identity theft monitoring, incident triage, a personalized response playbook, and quarterly structured security reviews.
The substance of the service is described in more detail on /services and /pricing. The descriptions there are part of these Terms.
The intake conversation, the security profile we deliver afterward, and the operational scope documented in your profile together form the specific scope of service for your account.
3. Eligibility and your account
You must be at least 18 years old and able to form a binding contract in your jurisdiction to use the service. You must provide accurate information during intake, and you must keep your household information current so that we can deliver the service.
You are responsible for keeping your account credentials secure and for activity that occurs under your account. If you believe your account has been compromised, contact us immediately.
4. Acceptable use
You agree not to use the service to violate any law, to harm minors, to send communications you have no right to send, to infringe intellectual property, to distribute malware, to attempt to gain unauthorized access to systems we operate or to systems operated by our vendors, or to interfere with other households' use of the service.
You also agree not to provide us with information about a household member you are not authorized to share, and not to impersonate any person or entity in your intake responses.
5. Fees and payment
The Family Plan is currently priced at $250 per month, billed monthly, with no minimum term and no contract. The price displayed on /pricing at the time of your subscription is the price you pay.
Billing will be handled through a third-party payment processor; payment information is collected and stored under that processor's privacy and security terms, not ours. We will tell you which processor handles billing before you provide payment information.
Subscriptions to future tiers (Essentials and Elite) will become available as we build them. Pricing for those tiers, when offered, will be listed on the pricing page before they become buyable.
If a payment fails, we will notify you and attempt to collect payment. If we cannot collect payment after a reasonable period, we may suspend your service as described in section 6.
6. Cancellation and suspension
You can cancel your subscription at any time, with no cancellation fee. Cancellation takes effect at the end of the then-current billing period unless you request immediate cancellation.
We may suspend or terminate the service if you materially breach these Terms, fail to pay fees, or use the service in a manner that creates a security or legal risk for us or for other households. Where appropriate, we will give you notice and an opportunity to cure before suspension.
On cancellation or termination, we will, on your request, delete or return the personal information we hold about your household, subject to the retention exceptions described in our Privacy Notice.
7. Disclaimers
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the service will detect every security event that affects your household, that no security event will occur, or that our recommendations, if followed, will prevent every possible outcome. Cybersecurity involves inherent uncertainty; our service is designed to materially reduce that uncertainty, not eliminate it.
8. Limitation of liability
To the maximum extent permitted by law, our total cumulative liability arising out of or relating to the service will not exceed the greater of (a) the amount you paid us for the service in the twelve months preceding the event giving rise to the liability and (b) one hundred US dollars (US$100).
Neither party will be liable to the other for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of those damages.
The limitations in this section apply to the maximum extent permitted by applicable law and do not apply to liability that cannot be excluded or limited as a matter of law (including gross negligence, willful misconduct, or death or personal injury caused by negligence).
9. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
SafeHaven is operated by an entity organized under the laws of the State of Texas. The full registered name and principal place of business of that entity will be provided on written request and is set out in our responses to verifiable consumer inquiries, as required by Texas Business and Commerce Code §130A.107.
We will try to resolve any dispute informally first. If we cannot, you agree that any claim arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in the State of Texas, and you consent to the personal jurisdiction of those courts.
Nothing in this section prevents either party from seeking injunctive or other equitable relief to protect intellectual property or confidential information in any competent jurisdiction.
10. Changes to these terms
If we make material changes to these Terms, we will post the revised Terms with an updated "Last updated" date and, where the changes affect ongoing subscriptions, notify you at the email address on file at least 30 days before the changes take effect.
If you do not agree to the revised Terms, you can cancel your subscription before the changes take effect, in which case the prior Terms will apply through the end of your then-current billing period.
